Can Online Gambling Be Enforced?

Gambling, including sports betting and casinos, has become an increasingly popular hobby in the United States. Several states, however, have yet to legalize online gambling.

The Wire Act, the Travel Act, and the Illegal Gambling Business Act all prohibit illegal Internet gambling. These acts also make it illegal to transmit information over the internet, such as wagering information, about a sporting event.

Several courts have addressed the issue of the constitutionality of enforcing these federal criminal statutes against gambling businesses. Most of the cases have involved state law or the First Amendment, but some of them have based their arguments on the Commerce Clause or the Due Process Clause. In any case, the attacks have had little success.

For example, the 10th Circuit found that the Wire Act applied to gambling on sporting events, while the Fifth Circuit held that it did not apply to bars and clubs that offered video poker machines. Other courts have ruled that a bartender who served drinks to bettors or a manager of a restaurant with video poker machines was acting in a gambling capacity.

Another federal statute, the Racketeer Influenced and Corrupt Organizations (RICO) provisions, prohibits the illegal operation of a gambling business. Those who operate illegal gambling businesses may be charged with up to five years in prison.
